Welcome to the Website for the Center for Public Violence Recovery, a program of Village Life Company, Columbia, MD, a 501(c)3 nonprofit organization. By using or visiting this Website, You acknowledge your agreement to the Terms of Service (TOS) that appears on this page; our Privacy Policy; and all other terms referenced here  for the use of Center for Public Violence Recovery's Website. 1. Revision date
These Terms of Service were last revised on July 28, 2018.

2. Acceptance of Terms
Village Life Company (“Organization”) provides the publicviolencerecovery.org Website to you subject to the following Terms of Service ("TOS"). By using the publicviolencerecovery.org site (the “Site”), and in exchange for the Organization’s agreement to provide the Site to you, you agree to be bound by these TOS.

The TOS may be revised from time to time. We will indicate at the beginning of the TOS when they were last revised. Your continued use of the Site constitutes your agreement to all terms of the most recent TOS.  

You must be at least thirteen (13) years of age to use the Site. Any registration by, use of, or access to the Site by anyone under 13 is unauthorized, unlicensed, and in violation of these TOS. By using the Site, you represent and warrant that you are at least 13 years old.

The Organization reserves the right to refuse access to the Site or to any other service or product provided by the Organization, without notice, at any time, and for any reason.

3. Provision and Modification of Service
The Site includes software, services and content provided by the Organization. Some of the content of the Site is provided by users who submit content on the Site. The Organization takes no responsibility for such content.

You understand and agree that the Site is provided to you on an AS IS and AS AVAILABLE basis. The Organization disclaims all responsibility for the availability, timeliness, security, or reliability of the Site or any feature or software included in the Site. The Organization also disclaims all responsibility for the acts or omissions of third parties whose services, or content may be utilized in connection with the Site. You agree that the Organization shall not be liable for any such faults.

The Organization reserves the right at any time to modify or discontinue, temporarily or permanently, the Site (or any part thereof) with or without notice. The Site also may be subject to interruptions, caused by the Organization or others. You agree that the Organization will not be liable for any modification, suspension, interruption, or discontinuance of the Site.

4. Conditions on Use
The Organization grants you permission to access and use the Site as set forth in these TOS, and in exchange you agree as follows:
1. You will access and use the Site solely for your own personal use;
2. You will not use the Site in any illegal manner or for any illegal purpose, in any other manner that could damage, disable, overburden, or impair the Site, or in any manner inconsistent with these TOS;
3. You will not defeat or interfere with any security feature of the Site, or attempt to do so;
4. You will not reproduce, duplicate, copy, sell, trade, resell, or exploit, for any commercial purpose, any content, component, or feature of the Site without the prior written permission of the Organization, except for content which you have the prior written permission of the owner to use; and
5. You will not collect or harvest any personally identifiable information, including without limitation author or organization names or email addresses, from the Site; and

5. Your Conduct
You understand and agree that any User Content you submit to appear on the Site is intended to be made public, and that once made public User Content cannot be made private again. You consent to the public dissemination of all Content you submit to the Site. However, the Organization will generally not make your email address public through your Profile Page.  

You agree that you will not submit Content that you did not create or that you do not have permission to post, transmit, or share. You affirm that you own or have all intellectual property rights (including without limitation copyright and trademark rights), licenses, and permissions to User Content you provide that are needed to use and to authorize the Organization to use in the manner described in these TOS. By submitting Your Content, you warrant that it does not infringe any intellectual property rights of another person.

You understand that the Organization does not promise that Content you submit will be maintained by the Organization. You are solely responsible for creating backup copies of and replacing any Content you submit to the Site. You agree that the Organization has no responsibility or liability for the deletion of, or the failure to store or to transmit, any Content or other communications provided on or through the Site.

6. Rights to Use
All content and components of the Site (“Center for Public Violence Recovery Content”), including without limitation, the software, text, photos, video and audio content, graphics, and features, and all trademarks, service marks, and logos contained therein, are owned by or licensed to the Organization, subject to any copyrights or other intellectual property rights held by others pursuant to law. The Organization reserves all rights to the Center for Public Violence Recovery Content and any other component or content of the Site not expressly granted to you by these TOS.


7. Intellectual Property Rights
Village Life Company, Disaster News Network, Center for Public Violence Recovery, and www.publicviolencerecovery.org logos and product or service names are trademarks of the Village Life Company. All other trademarks appearing on the Site are trademarks of their respective owners and our reference to them does not imply or indicate any approval or endorsement by their owners unless such approval or endorsement is expressly made. References to other names and trademarks are necessary in the course of providing information and commentary about the subjects addressed on the Site.  

8. Third Parties
The Site may contain links to other third-party websites that are not owned or controlled by the Organization. Inclusion of, linking to, or permitting the use or installation of any third-party site does not imply approval or endorsement thereof by the Organization. The Organization has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third parties.

Your correspondence or dealings with, or participation in promotions of third parties found on or through the Site, are solely between you and such third parties. You agree that the Organization shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such third parties.

9. Privacy
As a condition of using the Site, you agree to the terms of the Center for Public Violence Recovery Privacy Policy, which may be updated from time to time, as expressed in the most recent version that exists at the time of your use.

10. Copyright
The Center for Public Violence Website, located at the Internet URL of www.publicviolencerecovery.org, (including, but not limited to text, design, photos, audio or other devices) is protected by U.S. copyright and other laws and is understood to be a collective work or compilation. If additional copyright notices or other restrictions appear elsewhere at www.publicviolencerecovery.org, they are considered to be incorporated into this notice.

Information appearing on the Websites of the Organization and third-party sites that are linked from its pages, is provided "as is" without warranties of any kind. If you are not satisfied with the information or other material provided by Village Life Company programs, or any of the terms and conditions of the Website, your sole and exclusive remedy is to stop requesting, reading or otherwise consulting, the Sites of Village Life Company.
 
To the fullest extent permissible and pursuant to applicable law, the Village Life Company, its producers, and its sponsoring partners disclaim all warranties of any kind, express or implied, including, but not limited to, any errors or delays in the reporting of news on this site, or for any actions taken in reliance thereon.

In particular, and without limitation, the Organization makes no warranty that (1) the Site will meet your requirements; (2) the Site will be uninterrupted, timely, secure, or error free; (3) the results that may be obtained from the use of the Site will be accurate or reliable; (4) the quality of any products, services, information, or other material purchased or obtained by you through the Site will meet your expectations; (5) any errors in the contents or components of the Site will be corrected; or (6) that the Site is free of viruses or other harmful components.

14. Limitation of liability
IN NO EVENT SHALL VILLAGE LIFE COMPANY, ITS DIRECTORS, MEMBERS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF OR INABILITY TO USE THE SITE, THE SERVICES, THE CONTENT OR THE MATERIALS CONTAINED IN OR ACCESSED THROUGH THE SITE, INCLUDING WITHOUT LIMITATION ANY DAMAGES CAUSED BY OR RESULTING FROM RELIANCE BY USER ON ANY INFORMATION OBTAINED FROM VILLAGE LIFE COMPANY, OR THAT RESULT FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES OR EMAIL, ERRORS, DEFECTS, VIRUSES, DELAYS IN OPERATION OR TRANSMISSION OR ANY FAILURE OF PERFORMANCE, WHETHER OR NOT RESULTING FROM ACTS OF GOD, COMMUNICATIONS FAILURE, THEFT, DESTRUCTION OR UNAUTHORIZED ACCESS TO VILLAGE LIFE COMPANY’S RECORDS, PROGRAMS OR SERVICES.  IN NO EVENT SHALL THE AGGREGATE LIABILITY OF VILLAGE LIFE COMPANY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SITE OR THE SERVICES OR TO THESE SITE TERMS EXCEED ANY COMPENSATION YOU PAY, IF ANY, TO VILLAGE LIFE COMPANY FOR ACCESS TO OR USE OF THE SITE.

In addition, the Organization will have no liability for damages arising from you (1) accessing, downloading, or otherwise obtaining any content or component of the Site, even if it results in the inadvertent transfer of harmful computer code, such as viruses, malware, or spyware; (2) unauthorized access to or disclosure or alteration of your transmissions or data; (3) statements or conduct of any third party on the Site; or (4) as otherwise provided in these TOS.

15. You agree to hold harmless and indemnify the Organization, its programs, affiliates, officers, agents, and employees from and against any third-party claim arising from or in any way related to your use of the Site, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs, and attorneys’ fees, of every kind and nature.
 
16. Other General Terms
Applicable Law and Venue. These Site Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of Maryland, applicable to agreements made and entirely performed within the State of Maryland, without resort to its conflict of law provisions. You agree that any action at law or in equity arising out of or relating to these Site Terms shall be filed only in the state and federal courts located in Howard County, Maryland, and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of these TOS.

Termination. Notwithstanding any of these Site Terms, Village Life Company reserves the right, without notice and in its sole discretion, to terminate your license to use the Site, and to block or prevent your future access to and use of the Site.

Severability. If any provision of these Site Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Site Terms and shall not affect the validity and enforceability of any remaining provisions.
